Composition of Commission 4.(1) The Commission shall consist of
(3) The Commission may from time to time appoint one of the other members to be the Deputy Chairman of the Commission. Extraordinary vacancies 5.(1) Any member of the Commission appointed by the Minister may at any time resign his office by giving written notice to that effect to the Minister. (2) If any such member of the Commission dies or resigns or is removed from office the vacancy thereby created shall be deemed to be an extraordinary vacancy. (3) An extraordinary vacancy shall be filled by the appointment of a member by the Minister. (4) Every person appointed to fill an extraordinary vacancy shall be appointed for the residue of the term for which the vacating member was appointed. (5) The powers of the Commission shall not be affected by any vacancy in its membership. Disqualifications for membership 6.(1) A person shall be disqualified for appointment by the Minister as a member of the Commission if (a) (b) (c) in Fiji or elsewhere (i) (ii) dishonesty; (iii) misconduct in the exercise of his official functions;
Meetings 7.(1) Meetings of the Commission shall be held at such times and places as the Commission or its Chairman appoints. (2) At any meeting of the Commission (3) The Chairman shall preside at every meeting at which he is present. (4) In the absence of the Chairman from any meeting the Deputy Chairman shall preside at that meeting. (5) A decision of a majority of the members present at any meeting shall be the decision of the Commission and in the event of an equality of votes the member presiding shall have a casting vote as well as a deliberative vote. (6) Subject to (7) No decision or determination of the Commission, and no proceedings before the Commission, shall be held bad for want of form, or be void or in any way vitiated by reason of any informality or error of form. Members and officers to maintain secrecy 8. (1) Every member of the Commission and every person engaged or employed in connection with the work of the Commission shall maintain and aid in maintaining the secrecy of all matters which come to his knowledge when carrying out his functions or duties under this Act and shall not communicate any such matters to any person except in the discharge of his functions and duties under this Act. (2) Any person who contravenes subsection (1) Members' emoluments 9. There shall be paid to the members of the Commission such emoluments by way of fees or allowances, and travelling allowances and expenses, as the Minister may determine. Support services 10. The Public Service Commission shall provide such secretarial and research facilities and services as may be necessary to enable the Commission to exercise its functions and powers. Functions of Commission 11.(1) The functions of the Commission shall be (a) to consider and determine the salary of the chief executive officer of each of the corporations and bodies specified (either by name or by class) in the First Schedule and the salaries of the holders of such other offices in those corporations and bodies as the Commission may prescribe; (b) notwithstanding anything to the contrary contained in the memorandum or articles of association of any Government controlled company, to consider and determine the salary of the chief executive officer of every such company and the salaries of the holders of such other offices in those companies as the Commission may prescribe; (c) to consider and determine the salary of every Permanent Secretary and supervising officer appointed pursuant to section (Cap. l) (d) to consider and determine the salaries of the chief executive officer of every city, town and district council constituted under the Local Government Act and the salaries of the holders of such other offices in those councils as the Commission may prescribe; (Cap. 125) (e) to carry out such other functions as may be conferred or imposed upon it by this Act or any other written law. (2) In carrying out its functions under paragraphs (a) to (d) of subsection (1), the Commission may fix scales of salaries and may specify the manner in which the scales of salaries fixed by it are to be applied. (3) Except as provided in this Act, where the salary payable to any person is fixed under this Act, no amount in excess of the salary so fixed shall be paid to any person on account of that salary. (4) Any person who makes any payment in contravention of subsection (3) Release of determinations 12.(1) The Commission shall ensure that every determination made by it in respect of the salary of any person is made known to that person and to the person responsible for the payment of the salary, and to such other persons as have, in the opinion of the Commission, a direct interest in the subject matter of the determination. (2) The Commission shall submit to the Minister copies of all determinations made by it under section 11. (3) Subject to subsection (4) the Commission shall publish, in such manner as it (4) Where the Commission considers in relation to any particular corporation or body specified in the First Schedule or any Government-controlled company that it is not in the public interest to publish particulars of the salaries of officers of that corporation, body or company, the Commission shall not publish particulars of the salaries of those officers. (5) Except as expressly provided by this Act, determinations of the Commission shall not be published by the Commission. (a) 1 December 1983 in the case of the first determination made by the Commission under this Act; (b) twelve months before the date on which the determination is made in the case of any subsequent determination by the Commission. No member of the Commission shall be personally liable for any act done or default made by the Commission in good faith in pursuance or intended pursuance of the powers or functions of the Commission under this Act. Other written law not to prevail 19.(1) Except as provided in subsection (2), this Act shall prevail over any other written law authorising any person or body to fix any salary which the Higher Salaries Commission has jurisdiction to determine by this Act. (2) Nothing in this Act shall affect the operation of the Counter-Inflation Act and, without prejudice to the generality of the foregoing, in the event of any conflict or inconsistency between a determination of the Commission under this Act and any order or requirement of the Prices and Incomes Board under the Counter-Inflation Act, the provisions of the Counter-Inflation Act shall prevail. (Cap. 73) Determination of Commission to prevail over contracts of service 20.(1) Every determination of the Commission shall prevail over any contract of service to the extent that there is any conflict between the determination and the contract; and the contract shall thereafter be construed and have effect as if it had been modified so far as necessary in order to conform to the determination. (2) Nothing in this section shall derogate from section 16. Consultation with Commission 21. Where any corporation or body specified in the First Schedule or any Government-controlled company or any council constituted under the Local Government Act considers that any salary which it proposes to agree to, or pay, will or may tend to lead to unreasonable disparities or inappropriate relativities with any salary determined by the Commission under section 11, it shall, before agreeing to or committing itself to the payment of, such salary, consult with the Commission and have due regard to any opinions expressed by the Commission and to any relevant salary determined by the Commission. (Cap. 125) Financial provisions 22. All fees, salaries, allowances and other expenditure payable or incurred under or in the administration of this Act shall be payable out of money to be appropriated by Parliament for the purpose. Annual report 23.(1) As soon as practicable after 31 December in each year the Commission shall submit to the Minister a report of its operations during that year. (2) The Minister shall cause a copy of the report to be laid before Parliament at the next meeting subsequent to Offence 24.(1) Subject to subsection (2), any person (2) In any proceedings for an offence under section 11 it (a) that the commission of the offence was due to a mistake or to reliance on information supplied to him or to the act or default of another person, an accident or some other cause beyond his control; and (b) that he took all reasonable precautions and exercised all due diligence avoid the commission of such an offence by himself or any person under his control.
